These AI Services, Subscriptions, and Credits Terms ("AI Service Terms") apply to your access to and use of AI Services, whether offered free of charge, as part of a software license, through a paid subscription, or through Credits, provided through My Bandicam Space, Bandicam AI Studio, Bandicam, Bandicut, or other websites, software, applications, or services designated by Bandicam Company LLC, a California limited liability company (the "Company"). Provisions concerning purchases, subscriptions, billing, Credits, expiration, and refunds apply only when you purchase or use the relevant paid offering. By accessing or using any AI Service, or by purchasing or using any paid AI subscription, credit package, or credit-based feature, you agree to these AI Service Terms.
These AI Service Terms supplement the Bandicam Terms of Service, the applicable End User License Agreement, and the Privacy Policy. If there is any conflict between these AI Service Terms and the Bandicam Terms of Service with respect to AI Services, paid AI subscriptions, Credits, or related features, these AI Service Terms will govern to the extent of that conflict.
1. Service Scope
1.1 The Company may provide AI-related features, including AI-powered content generation, transcription, subtitle generation, translation, editing support, background processing, video upload, chatbot support, and other related features (collectively, "AI Services"). AI Services may process data locally on your device using models stored or executed on your device ("On Device AI") or may be provided through Company-operated servers or external service integration.
1.2 AI Services may require a My Bandicam Space account, browser login, internet connection, compatible device or software environment, payment verification, credit balance, active subscription, or other conditions displayed in the Software, My Bandicam Space, or on the official website.
1.3 A purchase of a Bandicam or Bandicut software license does not automatically include all AI Services, paid AI subscriptions, credit packages, or credit-based features unless expressly stated at the time of purchase.
1.4 You must be at least 13 years old and meet any higher minimum age required by applicable law in your country or region to use the AI Services. If you are under the age of legal majority in your jurisdiction, you may use the AI Services and purchase paid AI subscriptions or Credits only with the consent of your parent or legal guardian. Your parent or legal guardian must agree to these AI Service Terms on your behalf and is responsible for your use of the AI Services.
2. Credit Types
2.1 "Credits" are virtual units that may be used for supported AI Services. Credits are not cash, electronic money, stored value, a deposit, a bank account, or any other financial instrument. Credits cannot be transferred, assigned, exchanged for cash, or used outside services designated by the Company.
2.2 "Subscription Credits" are credits included with a paid monthly or annual subscription plan. Subscription Credits are provided for use during the applicable billing period and expire at the end of that billing period unless otherwise stated by the Company or required by applicable law. Unused Subscription Credits do not roll over after cancellation, expiration, downgrade, or non-renewal of the subscription unless expressly stated.
2.3 "Purchased Credits" are credits purchased separately as a one-time credit package. Unless otherwise stated at the time of purchase or required by applicable law, Purchased Credits are valid for one year from the date of purchase.
2.4 "Bonus Credits" are free, promotional, trial, compensation, event, or courtesy credits provided at the Company's discretion. Bonus Credits have no cash value, are not refundable, may be subject to shorter expiration periods, feature restrictions, or usage limits, and may be changed, suspended, revoked, or discontinued by the Company to the maximum extent permitted by applicable law.
3. Subscription Plans and Renewal
3.1 Subscription plans may be offered on a monthly or annual basis. The credit allowance, supported features, billing period, price, and renewal terms are displayed at the time of purchase or in My Bandicam Space.
3.2 Unless otherwise stated, subscriptions automatically renew for the same billing period at the renewal price in effect at the time of renewal. The Company will provide prior notice or obtain consent where required by applicable law.
3.3 You may manage or cancel automatic renewal through the method provided by the Company or the applicable payment provider. If you do not cancel before the renewal date, the renewal fee may be charged.
3.4 Cancellation stops future renewals but does not automatically refund fees already charged for the current billing period, except where required by applicable law, due to the Company's intentional misconduct or gross negligence, or due to a material service defect attributable to the Company.
4. Credit Purchase, Use, and Deduction
4.1 The number of Credits required for each AI Service may vary depending on the service type, input length, output length, processing option, quality setting, model, retry, or other usage condition displayed by the Company.
4.2 Credits may be deducted when you submit a request, begin processing, receive a result, export a result, or otherwise use a supported AI Service as specified by the Company. If a request fails to produce or deliver an accessible result due to a technical error attributable to the Company or its designated service providers, any Credits deducted for that request will be automatically returned to your Credit balance and treated as unused for purposes of Section 5.1. System-initiated automatic retries will not result in duplicate Credit charges. Credits used for a request that successfully produces a result are not refundable or restorable merely because the result is delayed, inaccurate, incomplete, low quality, or otherwise unsatisfactory, except where required by applicable law.
4.3 The Company may determine the order in which Credits are used, including by expiration date, credit type, promotion terms, or other reasonable system rules. The Company's system records will be used to determine credit balance, usage, expiration, and deduction history unless there is clear evidence of error.
4.4 Credits may not be sold, transferred, shared between accounts, exchanged, resold, sublicensed, or used for any unauthorized commercial purpose unless expressly permitted by the Company.
5. Refunds
5.1 You may request a full refund of a Purchased Credit package within 14 days after purchase only if no Credits from that package have been used. Once any portion of the Purchased Credits has been used, the entire package becomes non-refundable. Credits automatically restored due to a technical failure will not be considered used for purposes of this Section. This policy does not limit any refund rights that cannot be waived under applicable law.
5.2 Subscription fees are generally non-refundable after Subscription Credits or paid subscription benefits have been used during the relevant billing period, except where required by applicable law, due to the Company's intentional misconduct or gross negligence, or due to a material service defect attributable to the Company.
5.3 Except for Credits automatically restored under Section 4.2 or as required by applicable law, used Credits are not refundable. Credits used for a request that successfully produces a result are not refundable merely because the result is delayed, inaccurate, incomplete, low quality, or otherwise unsatisfactory.
5.4 Dissatisfaction with AI-generated results, including results that are inaccurate, incomplete, low quality, unexpected, unsuitable for a particular purpose, or different from your preference, is not by itself a valid reason for refund.
5.5 Bonus Credits are provided free of charge and are not refundable, exchangeable, compensable, or replaceable unless required by applicable law.
6. User Content and Rights
6.1 When using AI Services, you are solely responsible for any audio, video, images, text, subtitle or transcript text, prompts, inquiries, processing settings, related metadata, processing results, or other materials that you upload, input, select, transmit, or process ("User Content").
6.2 You must have all rights, permissions, licenses, and consents necessary to upload, input, transmit, process, and use the User Content and any results generated from it. You may not upload, input, transmit, or process User Content that infringes or violates any third-party intellectual property rights, privacy rights, publicity rights, confidentiality obligations, contractual rights, or applicable laws.
6.3 You retain ownership of your User Content. You grant the Company and its designated service providers a limited license to host, transmit, process, reproduce, create technical intermediate copies of, modify for processing purposes, and display User Content and results solely as necessary to provide, secure, maintain, troubleshoot, and support the AI Services, subject to the Privacy Policy and applicable law.
6.4 The Company does not claim ownership of AI-generated output solely because it was generated through the AI Services. However, you are responsible for reviewing, verifying, and determining whether you may lawfully use, publish, distribute, or rely on any output.
6.5 Unless you separately and expressly opt in, the Company will not use, or permit its designated service providers to use, User Content or AI-generated output to train, retrain, fine-tune, or otherwise develop or improve any AI model. If the Company introduces an optional AI model training program, it will provide clear prior notice and obtain your separate affirmative consent. You may withdraw your consent at any time, and withdrawal will apply to future use of your content. This does not prevent the Company from using de-identified, aggregated, statistical, security, usage, or diagnostic data that does not reasonably identify you or reveal the substance of your User Content to operate, protect, measure, troubleshoot, and improve the AI Services.
7. Data Processing and External Service Providers
7.1 When you use Bandicam AI Studio or another AI Service identified as requiring cloud-based or online processing, and only when you execute such a feature, materials selected by you (including audio, video, images, text, subtitle or transcript text, inquiries, processing settings, related metadata, and processing results) may be transmitted to and processed by the Company or external service providers designated or notified by the Company for purposes such as transcription, subtitle generation, translation, editing support, background processing, video upload, customer inquiry processing, security, quality control, troubleshooting, abuse prevention, and user support improvement. AI features identified as On Device AI process selected materials locally and do not transmit those materials to the Company or external AI processing providers solely for that processing, unless you separately choose a feature requiring online transmission.
7.2 Personal information included in the materials described above will be processed in accordance with applicable law, the Company's
Privacy Policy, and any notices displayed in the relevant feature or service screen.
7.3 The Company may use external service providers, cloud infrastructure, payment processors, fraud prevention providers, customer support tools, analytics tools, and AI processing providers to operate the AI Services. Processing locations, retention periods, and provider details may vary depending on the service, region, feature, and applicable law.
8. AI Output and Service Limitations
8.1 AI Services and AI-generated output are provided for convenience only. Output may be inaccurate, incomplete, delayed, out of date, unsuitable for your intended purpose, offensive, or different from your expectations.
8.2 The Company does not warrant the accuracy, reliability, completeness, legality, originality, non-infringement, availability, uninterrupted operation, or fitness for a particular purpose of AI Services or AI-generated output to the maximum extent permitted by applicable law.
8.3 AI-generated output does not constitute legal, financial, medical, billing, technical, or other professional advice and does not create any contractual commitment on behalf of the Company. You are solely responsible for verifying important information and for decisions or actions taken based on AI-generated output.
9. Prohibited Uses
You may not use the AI Services, subscriptions, or Credits to:
1) violate applicable laws or third-party rights;
2) upload, generate, process, or distribute illegal, harmful, infringing, defamatory, deceptive, abusive, sexually exploitative, violent, hateful, or privacy-invasive content;
3) impersonate another person, misrepresent authorization, or process another person's content without required consent;
4) bypass usage limits, abuse promotions or Bonus Credits, create multiple accounts to obtain improper benefits, resell Credits, or interfere with billing, metering, security, or service systems;
5) reverse engineer, scrape, benchmark for competitive purposes, overload, attack, or attempt unauthorized access to the AI Services or related systems.
10. Suspension, Termination, and Changes
10.1 The Company may suspend or terminate access to AI Services, subscriptions, Credits, or accounts if the Company reasonably determines that you have violated these AI Service Terms, the Bandicam Terms of Service, payment obligations, applicable law, third-party rights, security rules, abuse prevention rules, or service integrity requirements.
10.2 The Company may modify, limit, suspend, discontinue, replace, or change AI Services, supported features, credit pricing, credit consumption rates, subscription plans, credit packages, Bonus Credits, or usage conditions. Material changes will be notified where required by applicable law.
10.3 If a service discontinuation or material change prevents you from using already purchased and unexpired Purchased Credits for the service originally offered, the Company will provide a reasonable remedy where required by applicable law.
11. Limitation of Liability
To the maximum extent permitted by applicable law, the Company will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, loss of business opportunity, loss arising from AI-generated output, or damages arising from your User Content, misuse of Credits, account compromise caused by your failure to safeguard credentials, third-party services, or inability to access AI Services. Nothing in these AI Service Terms excludes or limits liability that cannot be excluded or limited under applicable law.
12. Governing Law and Jurisdiction
12.1 Governing Law. These AI Service Terms and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by, and construed in accordance with, the laws of the State of California, United States, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly disclaimed and shall not apply.
12.2 Jurisdiction. Each party irrevocably agrees that the state and federal courts located in Orange County, California, shall have exclusive jurisdiction to settle any dispute, controversy, or claim arising out of or in connection with these AI Service Terms, the AI Services, subscriptions, Credits, or related paid services.
12.3 Class Action Waiver. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, YOU AND THE COMPANY AGREE THAT ANY PROCEEDINGS TO RESOLVE OR LITIGATE ANY DISPUTE WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS. NEITHER YOU NOR THE COMPANY WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS ACTION, AS A PRIVATE ATTORNEY GENERAL ACTION, OR IN ANY OTHER PROCEEDING IN WHICH EITHER PARTY ACTS OR PROPOSES TO ACT IN A REPRESENTATIVE CAPACITY.
12.4 Consumer Protection Exceptions. Notwithstanding the foregoing, if you are a consumer residing outside the United States, nothing in these AI Service Terms shall deprive you of the protection afforded to you by provisions of the mandatory laws of your country of residence which cannot be derogated from by agreement, including any rights you may have to bring a claim in the courts of your home country.
